ARKANSAS: Caldwell v. Arkansas Dep’t. of Human Services
02.18.2010 | Termination of Parental Rights

The Court of Appeals of Arkansas, Division Two reversed the circuit court’s order terminating appellant-father’s parental rights, holding that the circuit erred when it found that termination was in the child’s best interest. The court stated that termination of the father’s rights was not in the child’s best interest because it would not achieve any additional permanency for the child as she was currently in the custody of her mother and termination would jeopardize the child’s relationship with her paternal grandmother, a relationship that everyone agreed was in the child’s best interest.
